JUDICIAL COSTS IN UKRAINE


Judicial costs (also translated as the court costs, litigation costs, litigation expenses or judicial expenses) are recognized to include the judicial fee and costs related to consideration of the case.

The judicial fee is to be paid in all types of procedures except for the criminal proceedings. In fact this fee consists of two duties: the state duty and the fee for technical and information services, related to the case. The judicial fee is to be paid before filing compliant to the court; otherwise the compliant will be rejected by the court. Therewith the court can accept the compliant without the judicial fee paid, but suspend the case and compel the claimant to pay the fee, otherwise the compliant will be rejected without considerations. Also there is provided the list of exemptions allowing the claimant to file his claim for free.

In general the costs related to consideration of the case can include:

- fees for legal services (attorneys, legal advisers, law firms, etc.);

- expenses related to the appearance of parties and their representatives in the court;

- expenses related to the involvement of witnesses, interpreters and experts;

- expenses related to examination of evidence on site and implementation of other actions required for judicial proceedings.

Normally the losing party is to cover the judicial costs of the other party. However recovery of such costs can be reduced by the court proceeding from considerations of reasonability. And from the other hand the amount of judicial costs, which can be recovered for account of the state authorities is rather limited. Sometimes even having good judicial decision ordering the losing party to cover the judicial costs of the other party it is impossible to collect the same due to lack of assets of the losing party.
